Supreme Court Clarification
The Supreme Court clarified that maintenance charges related to apartments must be paid by the unit owners themselves. It was stated that from the time of purchasing the flat without any relation to occupancy, the management charges should be collected. The developer should bear the maintenance charges until they sell the flats. It suggested establishing a system for determining these charges, without specifying any formula. According to the 2016 Real Estate Act, each homeowner in a housing society is responsible for paying their unit's maintenance charges.
