The Supreme Court told Amrapali group founder and its former chairman Anil Kumar Sarma that he is not eligible for any lenience as he had cheated thousands of home buyers and felt that the fraud that he had perpetrated was by no means a small one. The apex court observed, “You had cheated thousands of home buyers, misusing their hard-earned money. You do not qualify for any lenience.”
The court remarked that what should be considered as how many thousands have been adversely affected by his acts of conning. In this backdrop, it felt that Anil Kumar Sarma is not eligible for showing any leniency. It remarked that it is advisable for him to spend his term in jail. This court knows very well how he conned the people. The transactions of the Amrapali Group caused loss to many customers.
It also commented that it is not able to find a way how to rescue them from the huge fraud perpetrated by the group. The SC Bench comprising Justice Ajay Rastogi and Justice Bela M Trivedi severely indicted the group founder. When the counsel for Sarma moved his bail application in the court as Sarma spent over four and half years in jail, the SC bench differed with his contention and described Sarma as unfit for showing any lenience by this court turning down his bail plea. The counsel argued before the Bench that if bail is granted to his client he would take steps to revive his company. Meanwhile, the SC entrusted the NBCC to complete the 16 projects of Amrapali group. According to a conservative estimate, Rs 8000 crore are required to complete the projects.
